On September 29, a jury in San Francisco returned a verdict in the government’s criminal case against former InterMune CEO Scott Harkonen. The jury convicted Harkonen of wire fraud in connection with an August, 2002, press release regarding the results of a clinical trial. The jury acquitted Harkonen, however, on a separate count for violating the Food, Drug and Cosmetic Act. The indictment can be found here.

Full disclosure: I helped represent InterMune while I was at Covington & Burling LLP.
