Omnicare, whistleblower reach agreement in principle to settle False Claims Act case for $120 million

On October 23, the long-term care pharmacy giant Omnicare, Inc., filed an 8-K statement with the SEC disclosing that it had reached an agreement in principle to settle allegations of kickbacks raised by a qui tam relator in the Northern District of Ohio, for $120 million.

The settlement is not only the largest announced so far in the 2014 fiscal year, it is the largest of any kind announced since May 2013’s settlement with Ranbaxy, and one of the largest settlements ever in a case in which the Department of Justice declined to intervene.
